Federal Judge Mandates Freedom of Abrego Garcia from ICE Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal custody.

In her order, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
